Terms and Conditions of marinesafety.vn

Last updated: 09 June 2026. These Terms take effect from the date of publication and apply to all transactions on the website marinesafety.vn, owned and operated by AZMARINE CO., LTD.

1. Scope of Application

These Terms and Conditions (the "Terms") govern the access and use of the website marinesafety.vn (the "Website") and any sale of goods or services between AZMARINE CO., LTD ("AZMARINE", "we", "us") and the customer ("you", "Customer"). By accessing the Website, placing an order or creating an account, you confirm that you have read, understood and agreed to be bound by these Terms and all referenced policies (Privacy Policy, Warranty Policy, Return Policy, Shipping Policy).

These Terms are drafted in accordance with the Civil Code 2015, Commercial Law 2005, Law on Protection of Consumer Rights 2023 (Law No. 19/2023/QH15), Decree 52/2013/ND-CP on e-commerce, Decree 85/2021/ND-CP amending Decree 52/2013/ND-CP, Decree 13/2023/ND-CP on personal data protection and other relevant laws of Vietnam.

For goods listed as conditional business lines under Vietnamese law, AZMARINE publishes its business eligibility licenses, certifications and/or distribution authorizations on its company page or makes them available upon reasonable request.

3. Definitions

  1. "Product" means goods and services offered by AZMARINE on the Website, including but not limited to life-saving equipment, fire-fighting equipment, marine communication equipment, marine technical equipment and spare parts.
  2. "Order" means a purchase request submitted by the Customer through the online ordering function, email, hotline or other official channel.
  3. "Contract" means the sale agreement formed between AZMARINE and the Customer upon AZMARINE's issuance of an Order Confirmation under Clause 6.
  4. "Account" means the Customer's registered account on the Website for tracking orders and transaction history.
  5. "Product Certificate" means documents evidencing the product's compliance, e.g. MED (Marine Equipment Directive), SOLAS, IMO certificates and classification society certificates (VR, DNV, BV, ABS, NK, LR, RINA, KR, CCS).

4. Account Registration and Information Security

You may place orders as a guest or by creating a registered account. When registering, you undertake to provide accurate, complete and up-to-date information and bear responsibility for its truthfulness.

You are responsible for safeguarding your username, password and any activity performed under your Account. Any use of the Account (including placing orders) is deemed performed by the Account holder. AZMARINE may suspend or terminate an Account where: (i) the information is found to be false; (ii) the Customer breaches these Terms; (iii) signs of fraud, system abuse or infringement of third-party rights exist; (iv) requested by competent state authorities.

You may request Account deletion by emailing [email protected]. AZMARINE will process the request within seven (07) business days of receiving a valid request.

5. Products, Prices and Promotions

All Products displayed on the Website carry key technical descriptions (manufacturer, model, certification, specifications, year of manufacture where applicable) in accordance with Decree 52/2013/ND-CP and Decree 85/2021/ND-CP. AZMARINE endeavours to keep information accurate; images are illustrative and may differ slightly from the actual product due to manufacturer revisions.

Listed prices are in Vietnam Dong (VND), exclusive of VAT and exclusive of shipping fees unless specifically noted otherwise. VAT is calculated and shown separately on the VAT invoice in accordance with tax law. Prices may change without prior notice; the price applicable to an Order is the price effective at the time AZMARINE issues the Order Confirmation.

For Products supplied to order (specialised equipment, non-stock items), AZMARINE issues a separate quotation valid for the period stated therein (typically 07–15 days). Promotions and B2B discounts apply under the conditions and terms announced for each programme.

6. Order Process and Order Confirmation

  1. Step 1 – Select product: The Customer selects products and quantities and adds them to the cart.
  2. Step 2 – Provide information: The Customer provides full name, delivery address, phone number, email and (if required) VAT invoice details.
  3. Step 3 – Accept Terms: The Customer confirms having read and agreed to these Terms before submitting the Order (mandatory mechanism under Article 33 of Decree 52/2013/ND-CP as amended).
  4. Step 4 – Submit Order: The Customer clicks "Place Order" to send a contract offer to AZMARINE.
  5. Step 5 – Confirmation: AZMARINE sends an acknowledgement email/SMS and contacts the Customer within 24 business hours to confirm stock, price and lead time. The Contract is formed only when AZMARINE issues a formal Order Confirmation (by email or in writing).

AZMARINE may decline or cancel an Order where: (i) the product is out of stock; (ii) a pricing or system error is identified; (iii) the Customer provides false information or cannot be contacted; (iv) the transaction is suspected of fraud; (v) the product is restricted for export/import to the delivery address. If the Customer has paid, AZMARINE refunds the full amount received within seven (07) business days.

7. Payment Methods

AZMARINE accepts the following payment methods:

  • Bank transfer to AZMARINE's corporate account (provided in the Order Confirmation or proforma invoice). Recommended for B2B and high-value orders.
  • Cash on delivery (COD) for orders below the threshold published at checkout and within the geographical area designated by AZMARINE.
  • Domestic ATM cards, credit cards or e-wallets via licensed Vietnamese payment gateways (where the feature is enabled).
  • Framework agreement / credit terms for B2B customers with a signed master agreement with AZMARINE.

All online payments are processed over SSL/TLS encryption. AZMARINE does not store complete payment-card data. Electronic VAT invoices are issued under tax law and sent to the email address provided in the Order.

8. Shipping and Delivery

AZMARINE delivers throughout Vietnam via its own fleet or reputable carriers (Giao Hang Nhanh, Viettel Post, J&T, specialised road carriers for oversize/overweight cargo). For international customers, AZMARINE supports export procedures under the Incoterms 2020 agreed in each specific contract.

Estimated lead times:

  • Stocked items at HCMC warehouse: 1–3 business days within the city; 2–5 business days nationwide.
  • Made-to-order items (in particular formal-import goods): 02–08 weeks depending on the manufacturer, as stated in the Order Confirmation.

Inspection on delivery (per Article 1.14 of Decree 85/2021/ND-CP): You have the right and are encouraged to inspect the external packaging and verify product codes against the delivery note before signing. For packages showing damage/dents/water exposure, please record the issue with the courier and contact AZMARINE within 24 hours. After you sign and the courier leaves, AZMARINE is not liable for shipping damage unless documented at handover.

Risk and title to the goods pass to the Customer upon the Customer's (or authorised representative's) signed acceptance of delivery.

9. Warranty, Returns and Refunds

9.1. Warranty

All Products distributed by AZMARINE carry the original manufacturer's warranty and ship with original factory certificates (MED, SOLAS, IMO, classification societies). AZMARINE undertakes to:

  • Supply Products that are 100% new, sealed in original packaging, with full labels, certificate of origin (C/O), certificate of quality (C/Q) and specialised certifications applicable to each product.
  • Provide a standard warranty period of twelve (12) to twenty-four (24) months from delivery, or the longer period stated by the manufacturer. The specific period is shown on the warranty card and/or invoice.
  • Provide free technical support, installation and use guidance throughout the warranty period.

The warranty does not cover:

  1. Products beyond the warranty period stated on the warranty card.
  2. Warranty seals or serial numbers that are torn, blurred, erased or mismatched.
  3. Damage from incorrect installation, use outside the design purpose or in an unsuitable operating environment.
  4. Damage from unauthorised disassembly or repair by parties not authorised by the manufacturer.
  5. Damage from natural disasters, fire, impact, water ingress beyond the IP rating, corrosion exceeding the protection grade, lightning or abnormal voltage.
  6. Consumable parts (batteries, indicator lamps, cartridges, packaging, seals) unless specifically provided otherwise.
  7. For life-saving/fire-fighting equipment: damage arising from failure to perform mandatory periodic maintenance and inspection per the manufacturer's instructions, the Vietnam Register and the SOLAS Convention (weekly, monthly, annual checks and the five-year overhaul under IMO Resolution MSC.402(96)).

9.2. Returns

Because marine safety equipment is specialised, certified goods with fixed serial numbers, AZMARINE does not accept returns for the Customer's subjective reasons (change of mind, mistaken order, post-purchase unsuitability). The Customer is responsible for confirming the model, specifications, certification and intended use before issuing the Order Confirmation.

AZMARINE accepts return/exchange requests only where the fault lies with AZMARINE or the manufacturer, namely:

  • The delivered product does not match the model or quantity in the Order Confirmation.
  • The product has a manufacturing defect within warranty that cannot be remedied by repair or component replacement.
  • The product was damaged in transit and documented in a handover record per Clause 8.

Return requests in the above cases must be submitted to AZMARINE within seven (07) days from delivery, together with the invoice, evidence and handover record (if applicable). The product must be in original sealed packaging with all accessories, labels and certificates.

Returns are strictly not accepted for products that have been used, installed on a vessel or facility, had seals broken (other than for a manufacturing defect), made to the Customer's specification (made-to-order), had certification activated/registered, or whose serial number/warranty seal has been tampered with.

9.3. Refunds

Where a refund is due, AZMARINE refunds within 07–14 business days of receiving the returned goods and confirming they meet the return conditions. Refunds are paid by bank transfer to the account provided by the Customer or credited against the next invoice for B2B customers.

10. Responsibilities of the Parties

10.1. AZMARINE's responsibilities

  • Provide complete and accurate product, price and policy information on the Website.
  • Deliver the correct quantity, type, quality and timing under the Order Confirmation.
  • Safeguard Customer information under Clause 12 and the separate Privacy Policy.
  • Receive and resolve complaints under the procedure in Clause 13.
  • Comply with the Law on Protection of Consumer Rights 2023 and other applicable laws.

10.2. Customer's responsibilities

  • Provide truthful and complete information when ordering and registering.
  • Pay in full and on time using the agreed method and term.
  • Inspect the goods upon delivery per Clause 8.
  • Use, store and maintain the Products per the manufacturer's instructions; for certified marine safety equipment, comply with periodic inspection schedules required by the Register and the SOLAS Convention.
  • Refrain from using the Website for unlawful purposes, attacking systems, destroying data, impersonating, sending spam or infringing third-party rights.
  • Refrain from copying or redistributing Website content for commercial purposes without AZMARINE's prior written consent.

11. Intellectual Property

All content on the Website — including but not limited to the "AZMARINE" logo, the "marinesafety.vn" brand, text, images, video, product descriptions, source code, interface and database — is the intellectual property of AZMARINE or is lawfully licensed to AZMARINE, and is protected under the Vietnamese Law on Intellectual Property and the international treaties to which Vietnam is a party.

Trademarks, logos and model names of manufacturers (Viking, Survitec, Lalizas, Daniamant, JOTRON, Kannad, McMurdo, etc.) belong to their respective owners and are used by AZMARINE in its capacity as an authorised distributor.

Any reproduction, modification, distribution, publication or commercial exploitation of Website content without AZMARINE's prior written consent constitutes infringement and may be sanctioned under applicable law.

12. Personal Data Protection

AZMARINE protects your personal data under Decree 13/2023/ND-CP on personal data protection, the Law on Cyber Information Security 2015 and the Law on Cybersecurity 2018.

  • Data collected: name, address, phone, email, company details (for B2B customers), order information, transaction history, IP address, browser data (cookies).
  • Purposes: order processing, delivery, invoicing, customer care, warranty, marketing communications (only with consent), and legal compliance.
  • Retention period: for the duration of service use and at minimum the period required by tax and accounting law (10 years for invoices).
  • Third parties with access: couriers, payment gateways, e-invoice providers, and competent state authorities upon lawful request.
  • Data subject rights: you may access, correct, request deletion, withdraw consent, restrict processing and complain in line with Chapter II of Decree 13/2023/ND-CP. Contact [email protected] to exercise these rights.

AZMARINE does not buy, sell or exchange personal data in any form.

13. Complaint Handling Procedure

  1. Step 1 – Receipt: Send your complaint to [email protected], hotline +84 938 697 839, or in writing to the head office. The complaint should state your details, the order code, the issue and any supporting evidence (photos, videos, handover records).
  2. Step 2 – Acknowledgement: AZMARINE acknowledges receipt within 24 business hours.
  3. Step 3 – Verification: AZMARINE works with the Customer, carrier and/or manufacturer to verify the matter within 03–07 business days.
  4. Step 4 – Resolution: AZMARINE proposes a resolution (exchange, warranty repair, refund, compensation) under Clause 9 and applicable law.
  5. Step 5 – Implementation: The agreed resolution is implemented within 07–14 business days of mutual agreement.

If no resolution is reached, you may escalate to the Competition and Consumer Protection Department (Ministry of Industry and Trade), the HCMC Department of Industry and Trade, or use the Ministry's online complaint system at http://online.gov.vn.

14. Force Majeure

Neither party is liable for delay or failure to perform caused by force majeure, including natural disasters, epidemics, war, strikes, embargoes, import/export restrictions, IT system failures beyond reasonable control, or decisions of competent state authorities. The affected party shall notify the other within 07 days of the event and take all reasonable steps to mitigate.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Vietnam. Any dispute arising out of or relating to these Terms or to transactions on the Website shall first be resolved through good-faith negotiation. If no agreement is reached within thirty (30) days of the dispute arising, the dispute shall be submitted to the competent People's Court in Ho Chi Minh City. For B2B customers, the parties may agree in a separate contract to refer disputes to the Vietnam International Arbitration Centre (VIAC).

16. General Provisions and Amendments

AZMARINE may amend these Terms at any time. The new version takes effect upon publication on the Website. The current version is always published at https://marinesafety.vn/terms (or an equivalent path) with the update date. Continued use of the Website or placing of orders after the amendment constitutes acceptance of the new version.

If any provision is held invalid, the remaining provisions remain in full force. A party's failure to enforce a right at one time does not waive that right.

These Terms are made in Vietnamese. The English translation is for reference; in case of discrepancy, the Vietnamese version prevails.
